CPN LEGAL MASTER CLASS: Insolvent trading and expert insolvency evidence

To celebrate the launch of the new CPN Legal Master Class Series, we invite you and your colleagues to attend an insolvency master class focussing on insolvent trading and expert insolvency evidence.

Part 1 – 7.30am to 8.15am  |  Insolvent Trading – Debts & Defences

The time when a debt is incurred is a critical issue to consider when mounting or opposing an insolvent trading claim. Led by Peter Fary and Carl Moller from the Victorian Bar, the first part of this master class will examine the complex issues surrounding the time when debts are incurred for the purposes of insolvent trading claims including:

  • Debts arising from continuing contractual arrangements.
  • Debts owing to revenue authorities.
  • Judgment debts and restitutionary debts.

The landscape of the statutory defences to insolvent trading is shifting. Part 1 will also discuss the existing statutory defences, the effect of the changes that are expected and how practitioners will need to respond.

Part 2 – 8.30am to 9.00am  |  Expert Evidence – Proving & Disproving Insolvency

Proof of insolvency is a fundamental issue in many liquidator’s claims and a matter of expert evidence. Overwhelmed by the volume and apparent complexity of expert witness statements, practitioners can fall into the trap of assuming that an opponent’s expert has proved insolvency.

Led by Andrew Yeo and David Vasudevan, two experts from Pitcher Partners Insolvency Division, Part 2 of this master class will critique the process of proving insolvency, will unpack solvency reports and provide practitioners with useful tools to unravel the mystery that is expert insolvency evidence.

Questions & Answers

Part 1 and 2 will include an opportunity to ask questions of our presenters.
